General Terms and Conditions (GTC)

K+K WineArtists Consulting AG

1. Scope of Application

These General Terms and Conditions (GTC) apply to all business relationships between K+K WineArtists Consulting AG, Wieslergasse 2, 8049 Zurich, Switzerland (hereinafter referred to as "K+K WineArtists Consulting AG") and its customers.

By placing an order or using a service, the customer agrees to these GTC.

Deviating conditions of the customer will not be recognised unless expressly agreed in writing.

2. Offer

The products, services, and information displayed on the website do not constitute a legally binding offer, but rather an invitation to order or make contact.

Price, range, and vintage changes are reserved at any time.

3. Conclusion of Contract

A contract is only concluded through the explicit order confirmation of K+K WineArtists Consulting AG or through the delivery of the goods.

The automatic order confirmation serves only to confirm the receipt of an order and does not yet constitute acceptance of the contract.

4. Prices

All prices are in Swiss Francs (CHF).

Unless otherwise stated, the prices include the legally required value-added tax.

Shipping costs will be shown separately.

Price changes are reserved.

5. Payment Terms

The following payment options may be offered:

  • Invoice
  • Prepayment
  • TWINT
  • Credit Card

K+K WineArtists Consulting AG reserves the right to exclude individual payment methods without giving reasons.

In the event of payment default, reminder fees and default interest may be charged.

6. Delivery

Delivery is generally made within Switzerland and the Principality of Liechtenstein.

Delivery may be made:

  • by K+K WineArtists Consulting AG
  • by affiliated producers
  • by distribution partners

Direct deliveries by producers or partners are considered proper contract fulfilment.

Specified delivery times serve as guidelines and are non-binding.

7. Retention of Title

The delivered goods remain the property of K+K WineArtists Consulting AG or the respective contracting partner until full payment has been made.

8. Youth Protection

The sale of alcoholic beverages is exclusively to persons aged 18 and over.

By placing an order, the customer expressly confirms that they have reached the required minimum age.

K+K WineArtists Consulting AG reserves the right to refuse or cancel orders without giving reasons.

9. Inspection of Goods

The customer must inspect the goods immediately upon receipt.

Complaints regarding:

  • Transport damage
  • Incorrect deliveries
  • Quantity discrepancies

must be reported in writing within five working days to info@kk-wineartists.ch.

Late complaints cannot be considered.

10. Wine Faults and Cork Taint

Natural products are subject to natural fluctuations.

In the case of proven wine faults, particularly cork taint, oxidation or other sensory defects, K+K WineArtists Consulting AG may, at its discretion:

  • Provide a replacement
  • Grant a credit note
  • Refund the purchase price

The return of the affected bottle may be requested for inspection.

There is no general entitlement to replacement.

11. Returns and Exchanges

There is generally no statutory right of withdrawal under Swiss law.

The return of correctly delivered and defect-free goods is excluded.

Excluded are:

  • Incorrect deliveries
  • Transport damage
  • acknowledged quality defects

12. Benefits programme of the Ordo Equestris Vini Europae

Verified members of the Ordo Equestris Vini Europae can receive a discount of 10% on selected products.

K+K WineArtists Consulting AG reserves the right to request suitable proof of membership.

There is no legal entitlement to the granting of the benefit.

13. Support programme for non-members

Customers can voluntarily participate in the support programme for the benefit of the Ordo Equestris Vini Europae.

As part of this programme:

  • the customer receives a price advantage of 5%
  • K+K WineArtists Consulting AG additionally provides funds for agreed support purposes of the order

The specific design can be adjusted at any time.

14. Services and consulting

Consulting services, sales support, market analyses, and other services are provided by individual agreement.

A specific economic success is not owed.

15. Liability

The liability of K+K WineArtists Consulting AG is excluded to the extent permitted by law.

In particular, no liability is accepted for:

  • indirect damages
  • consequential damages
  • lost profits
  • delivery delays by producers or logistics partners

Mandatory statutory liability provisions remain reserved.

16. Data Protection

The processing of personal data is carried out in accordance with the currently valid privacy policy of K+K WineArtists Consulting AG.

17. Changes to the GTC

K+K WineArtists Consulting AG may change these GTC at any time.

The version valid at the time of the order is decisive.

18. Applicable Law and Jurisdiction

Only Swiss law applies.

The place of jurisdiction for all disputes is Zurich, Switzerland.
